If You Have Been Abused

If you or your child has been abused, you need the protection of the law so you can heal and move on with your life. In Florida, you can obtain a restraining order, known as a petition for injunction against domestic violence, to get legal protection from your abusive spouse or former partner.

You can go to court and fill in a free, fill-in-the-blank petition alleging domestic violence. A judge will make a temporary decision, pending a hearing in the future, to give you a temporary injunction. Once your abuser receives notice of this injunction it is in effect.

Two to three weeks later, you will have a civil hearing in front of a circuit judge. At this hearing, he or she will decide if you need a permanent restraining order or to extend the temporary order.
